Refund & Cancellation Policy

Effective Date: 30 June 2025 — This policy applies to all services provided by Bholes Shankar Enterprises Private Limited, trading as BSEP Technologies.

1. General Refund Policy

BSEP Technologies invests significant time, technical expertise, infrastructure, and human resources from the moment an order or service request is confirmed. Accordingly, all payments made to BSEP Technologies are considered final and are generally non-refundable, except where expressly required by applicable mandatory consumer protection law in your jurisdiction.

All purchases of digital products, software, web development, mobile application development, IT services, consulting, subscriptions, hosting, maintenance, and other technology-related services are made on this basis.

Refunds are not available once work has commenced, resources have been assigned, digital access has been granted, or any portion of the service has been delivered.

2. Non-Refundable Payments

The following payments are strictly non-refundable under all circumstances:

  • Advance payments and booking fees
  • Project initiation and onboarding fees
  • Consultation and discovery fees
  • Design, development, and engineering charges
  • Domain registration charges
  • Hosting and server charges
  • Software licensing and subscription fees
  • API integration fees
  • Digital product purchases (once access has been granted)
  • Third-party service charges (passed through at cost)
  • Government and regulatory fees
  • Payment gateway and processing charges
  • Applicable taxes and statutory charges
  • Milestone payments once the milestone has been approved by the client

3. Client Responsibilities

Clients are responsible for providing complete, accurate, and timely information, content, approvals, credentials, and feedback throughout the project lifecycle.

Delays, incomplete deliverables, or project failures caused by the client’s failure to provide required inputs shall not constitute grounds for cancellation, refund, or any discount.

4. Change of Mind and Subjective Dissatisfaction

Refund requests based on any of the following grounds will not be accepted:

  • Change of mind or business direction
  • Business closure or insolvency
  • Budget constraints or financial difficulty
  • Change in business strategy or stakeholder preferences
  • Delays caused by the client
  • Lack of technical knowledge or internal resource constraints
  • Failure to use or integrate the delivered service
  • Change of management or ownership
  • Personal or subjective reasons
  • Dissatisfaction after approved work has been delivered in accordance with the agreed specification

5. Project Cancellation

If a client requests cancellation after a project has commenced, BSEP Technologies reserves the right to retain all payments received, covering work completed, resources allocated, project planning, administration, and direct operational expenses incurred.

Any remaining balance, if applicable, shall be determined solely at the discretion of BSEP Technologies after accounting for all costs and liabilities incurred.

6. Subscription and Recurring Service Cancellation

Clients on monthly, quarterly, or annual subscription plans may cancel future billing by providing written notice at least fifteen (15) days before the next renewal date. No refund shall be issued for the current billing period already paid. Access to services continues until the end of the paid period.

7. Service Suspension

BSEP Technologies reserves the right to suspend or terminate services immediately and without refund if the client:

  • Violates these Terms or any applicable law
  • Provides false, misleading, or fraudulent information
  • Uses our services in an unlawful or harmful manner
  • Engages in abusive, threatening, or defamatory conduct toward our team
  • Attempts unauthorised access to our systems
  • Misuses or infringes our intellectual property
  • Initiates a fraudulent or unjustified chargeback

8. Chargeback and Payment Dispute Policy

Before initiating any chargeback, payment dispute, or reversal with your bank, card network, or payment platform, you are required to contact BSEP Technologies directly and provide a minimum of fifteen (15) business days to investigate and resolve your concern.

BSEP Technologies maintains comprehensive transaction records including signed contracts, delivery evidence, communications, IP logs, and client approvals. All such evidence will be submitted to the relevant payment processor and card network (Visa, Mastercard, American Express, Discover, or otherwise) in response to any dispute.

Fraudulent, malicious, or unjustified chargebacks may result in:

  • Immediate suspension and permanent termination of all services
  • Recovery of the full disputed amount, chargeback fees, and administrative costs through civil legal proceedings
  • Reporting to fraud prevention databases and networks
  • Referral to law enforcement agencies in the client’s jurisdiction (including the FBI IC3 in the USA, Action Fraud in the UK, the Canadian Anti-Fraud Centre, and equivalent bodies internationally)
  • Civil and/or criminal legal action under applicable laws of the client’s country

9. Discretionary Refunds

Any refund granted by BSEP Technologies is entirely at the sole discretion of the Company, unless a refund is expressly required under mandatory applicable law. The approval of one refund request shall not create any obligation, precedent, or expectation for future refund requests.

10. Consumer Rights in Specific Jurisdictions

Nothing in this policy is intended to limit or exclude rights that cannot lawfully be excluded or limited under applicable mandatory consumer protection laws in your jurisdiction, including:

  • United Kingdom: Consumer Rights Act 2015 and applicable FCA regulations.
  • European Union: EU Consumer Rights Directive (2011/83/EU) and applicable national consumer protection law.
  • United States: Applicable state consumer protection statutes (including California Consumer Protection Act, New York General Business Law, and equivalent statutes).
  • Canada: Applicable provincial consumer protection legislation.
  • Australia: Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010).

Where mandatory consumer rights apply, those rights take precedence over this policy to the extent required by applicable law.

11. Force Majeure

BSEP Technologies shall not be responsible for delays or non-performance due to events beyond our reasonable control, including natural disasters, pandemics, cyber-attacks, internet outages, government actions, power failures, or third-party service interruptions. Such events shall not entitle the client to a refund.

12. Limitation of Liability

Under no circumstances shall BSEP Technologies be liable for indirect, incidental, consequential, special, or punitive losses, including loss of revenue, profits, goodwill, data, business opportunities, or anticipated savings, arising from any service or payment-related matter covered by this policy.

13. Governing Law

This Refund & Cancellation Policy is governed by the laws of India. Any dispute shall be subject to the jurisdiction of competent courts in New Delhi, India, without prejudice to our right to seek enforcement in any jurisdiction where the client or client’s assets are located.
